1. Acceptance of Terms
Welcome to Topqer. These Terms of Service ("Terms") govern your access to and use of the Topqer platform, including our mobile applications, website, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
Topqer is operated by Accron Revolutions (Private) Limited, a company incorporated under the laws of Sri Lanka ("Topqer," "we," "us," or "our").
2. Description of Service
Topqer is a managed marketplace that connects homeowners ("Clients") with verified home service professionals ("Service Providers") across Sri Lanka. Our Platform facilitates:
- Browsing and requesting home services across multiple categories
- On-site inspections and transparent, itemised quotes
- Matching with verified and background-checked professionals
- Real-time tracking of service delivery
- Secure escrow-based payment processing
- Reviews and ratings for quality assurance
Topqer acts as a managed intermediary and is not a direct provider of home services. Service Providers are independent professionals or businesses, not employees of Topqer.
3. User Accounts
3.1 Registration
To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify Topqer immediately of any unauthorised use of your account.
3.3 Eligibility
You must be at least 18 years of age and have legal capacity to enter into binding agreements to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.
4. Service Requests and Inspections
4.1 Submitting Requests
Clients may submit service requests through the Platform by describing the service needed, uploading relevant photographs, and selecting preferred time slots. All requests are subject to availability and matching.
4.2 Inspection-First Model
All service requests undergo an on-site inspection by a verified professional. The purpose of the inspection is to accurately assess the scope of work, materials required, and provide a transparent, itemised quote. There is no obligation to proceed after receiving the quote.
4.3 Quote Approval
After receiving the inspection-based quote, Clients may approve, request modifications, or decline the quote. Work commences only upon Client approval. Approved quotes constitute a binding agreement between the Client and the Service Provider, facilitated by Topqer.
5. Payments and Escrow
5.1 Escrow Protection
All payments on the Platform are processed through Topqer's escrow system. Upon quote approval, the agreed amount is held securely in escrow. The Service Provider receives payment only after the Client confirms satisfactory completion of the work.
5.2 Payment Methods
The Platform supports various payment methods including credit/debit cards, bank transfers, and approved digital payment solutions. All transactions are processed in Sri Lankan Rupees (LKR).
5.3 Service Fees
Topqer charges a service fee on transactions facilitated through the Platform. Service fees are transparently disclosed before quote approval and are included in the total amount shown to the Client.
5.4 Refunds
Refund requests are handled on a case-by-case basis through our dispute resolution process. If work is not completed or does not meet the agreed-upon standards, Clients may be eligible for a full or partial refund from escrow.
6. Service Provider Obligations
Service Providers on the Platform agree to:
- Maintain valid registration, licences, and certifications as applicable
- Complete verified background and skill assessments
- Provide accurate, transparent quotes based on on-site inspections
- Deliver services to the agreed-upon standards and timelines
- Maintain appropriate insurance coverage
- Comply with all applicable laws and regulations in Sri Lanka
7. Client Obligations
Clients using the Platform agree to:
- Provide accurate descriptions and information for service requests
- Ensure safe and accessible working conditions for Service Providers
- Respond promptly to inspection schedules and communications
- Make timely payments for approved and completed services
- Provide honest and fair reviews and ratings
8. Dispute Resolution
In the event of a dispute between a Client and a Service Provider, Topqer will act as a mediator and work to achieve a fair resolution. Both parties agree to participate in Topqer's dispute resolution process in good faith before pursuing any external legal remedies.
Disputes must be raised within 7 days of service completion through the Platform's dispute resolution feature.
9. Intellectual Property
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, software, and the overall design and layout, are the exclusive property of Topqer or its licensors and are protected by Sri Lankan and international intellectual property laws.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Topqer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Topqer's total liability for any claims arising from the Platform shall not exceed the total amount of fees paid by you to Topqer in the twelve (12) months preceding the claim.
11. Termination
Topqer reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Any pending transactions or escrow amounts will be handled in accordance with our escrow policies.
12. Modifications to Terms
Topqer may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
